This Privacy Policy may be update in the future according to, among others, new legislative or jurisprudential requirements and/or business needs. Any update or modification of the present Privacy Policy will be considered applicable from the moment of its publication on our webpage. All  Users are therefore recommended to regularly review this section of our website.

ETIASEU will bear any type of responsibility for circumstances that are beyond our company’s reasonable control, such as being provided with erroneous, incomplete, and/or fraudulent information from Users.

Users providing ETIASEU with personal data of third parties, minors or adults either, must confirm our company that they have informed such parties about the purposes for which their personal data will be used and processed by ETIASEU and must also confirm that Users have obtained the third parties’ prior and express consent to transmit their personal data to our company.

Users providing personal data of a minor, must assure to be the minor’s parent or legal guardian.

Moreover, please note the following:

  • if ETIASEU receives an adult’s personal data and/or private information so as to submit his/her/their Electronic Travel Authorization application from an individual who has not requested his/her consent to communicate us his/her personal data, our Company will inform the data subject of how his/her personal data and/or private information has been collected. In addition, we will ask the subject who provided the personal data to our Company to confirm whether he/she requested the consent of the data subject and, if necessary, to amend this circumstance. In any case, the data subject will at all times have the faculty of objecting about the use and processing of his/her personal data by the our Company, in which case our professional services will not be possible to perform, implying therefore that the submission of the Electronic Travel Authorization application will be canceled.
  • In case ETIASEU receives a minor’s personal data and/or private information to submit his/her Electronic Travel Authorization application from a person who is not his/her parent and/or legal guardian, our Company will proceed to take the appropriate measures to fix the situation (including for instance the possibility of canceling the submission of the Electronic Travel Authorization application) as soon as our Company detects and/or becomes aware of these circumstances.

 

What does ETIASEU use your personal data for?

Our website users’ personal data is processed for the following purposes:

  • To provide the users with our specialized professional services aimed at the submission of the users’ Electronic Travel Authorization application. This means that ETIASEU work team will verify that the users have correctly filled out their application form and (if applicable) that they have provided the required documents and also that such documents meet with the institutional requirements. Should that not be the case, ETIASEU will ask the users for the missing and/or incomplete information and/or documentation when necessary.
  • To send users up-to-date information according to Government updates and/or operational communications regarding the status of the Electronic Travel Authorization application, as well as its outcome. To this extent, ETIASEU will notify users if EU institutions will require additional personal information and/or supplementary documentation in order for their application to be assessed;
  • To properly address a user’s request for information, claims or queries about us and/or our professional services and/or to complete your refund and cancellation requests;
  • For administrative purposes related to the processing and management of our professional services, such as verification of users’ payment information (fraud control), accountancy and billing tasks;
  • To comply with our legal obligations and/or to respond to judicial, police or to the corresponding authorities requirements;
  • To improve the users’ experience on ETIASEU website and also to improve our services and customer support by analyzing Users’ behavior while navigating through our company’s website;
  • To carry out periodic checks against fraudulent, unauthorized, or illegal activity on/or through ETIASEU website.

 

What is the legal basis for ETIASEU to processing users’ personal information?

ETIASEU only processes personal data of its users and clients when there is a legal basis for doing so. The legal basis depends on the reason why our company collects and processes the users’ personal data. In a bast majority of cases, such legal basis will be:

  • To fulfill the contract with ETIASEU’s users, to check the accuracy of their Electronic Travel Authorization application form and submit it before the Institutions of the European Union; to update users concerning the status of their application and so as to communicate with them about the official outcome of their Electronic Travel Authorization’s application; to provide feedback to users’ requests of information addressed to our Customer Service Department, among others.
  • The consent that users give to ETIASEU for the processing of their personal data in connection to the purposes communicated at the time of collection of your data (i.e. to be provided with the requested information by writing to our Customer Service team).
  • For compliance with our company’s legal obligations and/or to fulfill the requirements of administrative, judicial, police or corresponding authorities.
  • ETIASEU’s legitimate interest concerning (i) credit/debit cards and other methods of payment verification, (ii) address possible claims regarding the services our company offers, (iii) enhancing the users’ experience on our website so as to allow the users themselves to operate it efficiently, (iv) enhance the quality of the professional services we provide, (v) monitor fraudulent activity in order to preserve the security and integrity of ETIASEU website.

 

How long does ETIASEU keep users personal data for?

ETIASEU will process its clients and users’ personal data for as long as necessary to fulfill the purposes for which it was collected and, after that, your personal data will be retained, duly securely blocked, for the necessary period we need to keep it.   • To the Government of the country users are going to visit as it is the competent body to approve or deny the Electronic Travel Authorization applications.
  • To ETIASEU payment service providers to process the payment of the costs related to the Electronic Travel Authorization application process and to carry out fraud controls, as well as to the user’s bank entity credit/debit card companies when they have forwarded a dispute of the charges made.
  • To ETIASEU’s technology service providers which host our information systems and/or that offer us tools or technological support.
  • To comply with our company’s legal obligations and when administrative, judicial and/or police authorities require it in accordance with the applicable law and regulations.
  • To protect our company’s legitimate interests in the event that a claim may arise regarding the professional services offered.

The third parties mentioned above may have their headquarters outside the European Economic Area, therefore the personal data will be subject to international transfer. To this extent, we inform ETIASEU clients and users that our company will only transfer personal data to recipients located in countries that offer a level of personal data protection comparable to the laws and regulations of data protection of European countries or, failing that, that our company will apply the appropriate safeguards required by the current applicable law and regulations on the protection of personal data, in order to ensure the privacy and security of all users and clients personal data and that their individual rights are guaranteed.

How does ETIASEU protect users and clients’ personal information?

Users and clients’ personal data is securely stored in ETIASEU’s information systems and our company have established the state of the art technical and organizational measures in order to ensure the confidentiality and integrity of personal data and to protect it against unauthorized or unlawful processing and/or accidental loss, destruction or damage.

Even though ETIASEU pledges to do its best to guarantee the protection of users and clients personal data transmitted through its website and/or that may be provided to our company through others means such as email or phone, all users are still reminded they should also take precautions to keep their personal data safe, for instance do not enter or confirm bank details by means of fake messages and/or websites.

What rights do ETIASEU users have and how can they exercise them?

Users and clients of ETIASEU may exercise rights of access, rectification, erasure, restriction of the processing, objection, as well as the right to the portability of their personal data, with a written request addressed to us, sent by email to: contact@etiaeu.eu or by means of our Contact Form.

Data protection right request will be responded to within one (1) month; but occasionally, this period may be extended by two (2) further months where necessary, considering the complexity and/or the number of requests clients may have made. In such case, our team will notify you of such an extension together with the reasons for the delay.

When users consider it appropriate, they have the right to file a complaint before the corresponding Supervisory Authority, e.g. if they consider that their data protection rights have not been adequately addressed.
